After finding classified documents: Biden needs an explanation

US President Joe Biden expressed his surprise at the discovery of secret government documents in his private office and pledged his “full cooperation” with the investigation.

His lawyers did what they had to do to immediately report the discovery to the National Archives, Biden told reporters in Mexico City, where he was part of a U.S.-Mexico-Canada summit. As the government files were taken to the office, he wondered what they contained. His lawyers advised him not to ask about the content. The Department of Justice is investigating the matter. Biden said he hoped the investigation would conclude soon.

It seems that he was in possession of ten secret documents

The classified documents from his time as US Vice President under Barack Obama were held in private offices at the Ben Biden Center in Washington. When Biden cleared out his office, his lawyers found a box of classified documents in a “locked closet.” These are 10 classified documents, some of which are highly classified. According to CNN, it also includes documents from the US Secret Service of other countries such as Ukraine, Iran or Great Britain.

The documents were discovered on November 2 and turned over to the National Archives, the White House announced. They are not subject to prior request from the archive. In the United States, government documents are generally required to be archived and preserved for posterity. The case is being investigated by the judiciary.

According to special counsel Richard Saber, Biden used the office after his vice presidential run ended in 2017 and before his presidential campaign began in 2019.

Republican: “Biden must be impeached”

The discovery is particularly explosive because Biden’s predecessor, Donald Trump, has been targeted by investigators since his tenure in office, holding classified government documents. Over the summer, federal police and the FBI seized thousands of documents at Trump’s private home in Mar-a-Lago, Florida. The investigations against Trump have been going on for months. By doing so, the former president may have made himself punishable. Biden had criticized Trump’s behavior in September as “irresponsible.”

For Republicans, the documents now found on Biden are a godsend: Biden did the same as his predecessor Trump, according to House of Representatives Committee Chairman Steve Scalise. “When the then-Vice President took classified documents and kept them for years, while criticizing Trump for doing the same, you have to wonder why the press didn’t ask him the same questions as Trump.”

One of Trump’s closest allies in Congress, his far-right colleague Marjorie Taylor Greene, goes a step further. The incident is evidence of a Justice Department using a double standard of “Biden should be impeached.”

Republicans in Congress now want to investigate the process themselves. They asked the White House to hand over all related documents by January 24.

Differences between cases

It’s still unclear how secret the documents were, what they contained, and who had access to them over the years, with the discovery coming to light just before the midterm elections. “The mishandling of classified documents is always a serious matter,” former prosecutor Brandon Van Graak told NPR radio. However, he points to differences between Trump and Biden: Biden’s lawyers would have directed the National Archives, which the Justice Department reported. On the other hand, in Trump’s case, most of the documents were discovered only during the raid at Mar-a-Lago.
